Draft: these Terms have not been reviewed by a lawyer yet and may change.

Effective date: October 20, 2026

1. Who we are and what these Terms cover

These Terms of Service ("Terms") are a contract between you and Create ("Create," "we," "us," or "our"). They cover your use of the Create website and web app, including the tools for images, video, writing, editing and upscaling, Notes, Write, Canvas, Library, and anything else we offer under the Create name (the "Service").

By creating an account, using the Service, or clicking to accept, you agree to these Terms. If you use the Service for a company or other organization, you confirm you can bind it to these Terms, and "you" includes that organization. If you do not agree, do not use the Service.

These Terms work together with our Privacy Policy, our Acceptable Use Policy, and our Refund and Cancellation Policy. All four apply to you. If a rule in one of them is stricter than a rule here, follow the stricter one.

2. Accounts and eligibility

Creating an account is free, but you need a paid plan to use the AI tools. You must be at least 18 years old, or the age of legal majority where you live if that is higher, to use the Service or buy a plan. We do not knowingly allow anyone under 13 to have an account, and we will close any such account we find.

You must give accurate information when you sign up and keep it up to date. You sign in with an email address or with a Google account. Keep your sign-in details private. You are responsible for everything that happens under your account. Tell us quickly if you think someone else has accessed it. Accounts are personal. Do not sell, share or transfer yours without our written consent.

Do not make more than one account for yourself, impersonate anyone, or make accounts in bulk or with automated tools.

3. Paid plans, credits and billing

There is no free plan and no free trial. Every AI tool needs a paid plan. The plans are Basic, Pro, Max, Business and Enterprise. Enterprise is priced by contract, so there is no list price. The prices below are in US dollars and are shown again at checkout before you pay.

  • Basic: US$10 per month, or US$8 per month billed once a year (US$96 a year). Includes 1,000 credits.
  • Pro: US$30 per month, or US$24 per month billed once a year (US$288 a year). Includes 3,200 credits.
  • Max: US$80 per month, or US$64 per month billed once a year (US$768 a year). Includes 9,000 credits.
  • Business: US$200 per month, or US$160 per month billed once a year (US$1,920 a year). Includes 22,000 credits.

Yearly billing is 20 percent cheaper than paying monthly. You pay the whole year in one payment, and the plan renews once a year.

Payments are handled by Stripe. We do not see or store your full card number. When you buy a plan you authorize Stripe to charge your payment method for the plan price, plus any taxes, now and again at the start of each billing period. Prices are shown before tax. We do not add tax at checkout today. If that changes, any tax will be shown at checkout before you pay.

Plans renew automatically at the then-current price until you cancel.

You can cancel at any time. Open your Account page and choose Manage next to your plan to open the Stripe customer portal, where you can cancel. Cancelling stops the next renewal. Your plan stays active until the end of the period you already paid for, then it ends and you can no longer use the AI tools. Your account, Library and saved files stay available while your account is open.

If a payment fails, Stripe may try the charge again and we may email you. If the payment is not completed, your plan ends and the AI tools stop working until you pay.

If we change the price of a plan, we will tell you before it applies to your next renewal. If you do not accept the new price, cancel before the renewal.

Refunds and cancellation are explained in our Refund and Cancellation Policy, which is part of these Terms.

Credits

Credits are how a plan measures what you can generate. Credits are not money, have no cash value, cannot be refunded as cash, and cannot be sold, traded, gifted or moved to another account.

Each plan includes a set number of credits (listed above). Plan credits renew over a rolling 30 days. Unused plan credits do not roll over to the next period.

If you run out, you can buy a one-time top-up pack: 500 credits for US$6; 2,000 credits for US$22; 6,000 credits for US$60. Top-up credits do not renew, are used up once, and expire 12 months after you buy them.

How many credits a generation costs depends on the tool, the model and the settings you choose, and may change as the models we use change. Failed generations are not charged.

We keep a record of each generation, with the date, the tool, the model and the credits used, so you can see your usage at /account/usage.

We also set fair-use limits, such as how many generations you can start per minute and how many credits you can use in a rolling 30 days. We may slow, queue or limit requests to keep the Service stable and to stop abuse, even on plans that describe a large allowance. Do not try to get around credit, rate or usage limits, including by using several accounts.

4. Your content

"Your Content" means what you put into the Service: prompts, uploaded images, video, audio and files, notes, documents, and anything you type or say into our tools. You keep all ownership of Your Content.

You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display Your Content, and to send it to the AI providers described in section 6, only as needed to run the Service for you. That means to make your generations, save your Library, notes and documents, keep the Service secure, prevent abuse, fix problems, and follow the law. This licence ends when Your Content is deleted from our systems, apart from copies we must keep for the reasons in our Privacy Policy.

We do not use Your Content for advertising or marketing, we do not publish it, and we do not use it to train our own models or to train models shared with other users.

You promise that you have the rights needed to upload Your Content and give us this licence, and that Your Content and your use of it do not break the law or anyone else's rights. If Your Content shows or sounds like a real person, such as in a photo you upload for lipsync or editing, you promise that you have that person's permission. We may ask you for proof.

Before a generation runs, an automatic safety filter checks it, and prompts that clearly break the Acceptable Use Policy are refused. We do not routinely review everything you create, but we may review, block or remove content, and limit or end accounts, when we reasonably believe these Terms or the law have been broken.

5. Generated content (Output)

"Output" means the images, video, text and other results the Service generates for you. As between you and us, we claim no ownership of your Output. We give you whatever rights we have in it, and you may use it for personal and commercial purposes, such as marketing, products and client work, as long as you follow these Terms, the Acceptable Use Policy and the third-party rules in section 6, and your plan is in good standing when you generate it.

Output you generated while on a paid plan stays usable under this section after you cancel. New Output generated after your plan ends is not available, because the AI tools need a paid plan.

Be aware of the limits of Output:

  • Ownership of AI-generated material is unclear in many countries. Copyright may not protect Output at all, or may protect it only in part. We cannot promise you will own or be able to enforce rights in any Output.
  • Output is not guaranteed to be unique. Similar prompts can give similar or identical results to different people.
  • Output can be wrong, offensive, or can resemble existing works, brands or real people by accident. We do not check Output for third-party rights.
  • You are responsible for checking Output before you rely on it or publish it, especially for advertising, branding, client work, or anything about health, law or money.

6. Third-party AI models and their terms

Create does not build its own AI models. Each tool runs on models made by other companies. Depending on the tool and the day, these include OpenAI, Google, Black Forest Labs, ByteDance, xAI, Kuaishou (Kling), Alibaba, and others as models are enabled. Most are reached through the Vercel AI Gateway. The list changes as we add, swap or remove models.

Those companies have their own usage policies and terms. When you use a model through Create, their rules apply to that use as well as these Terms. Their rules can limit what you may do with Output, for example by restricting some commercial uses, requiring that you say the content is AI-generated, or banning certain subjects or uses of real people's faces and voices. If a provider's rule is stricter than ours, the stricter rule applies to Output from that model. We will try to show important provider rules in the Service, but you are responsible for following them.

A provider can change a model, block a request, or withdraw a model with little or no warning. We may change or remove models at any time. This is not a breach of these Terms, even if the style, quality or cost of a tool changes. A provider may also refuse a request because of its own safety filters. We cannot override that.

Your prompts and files are sent to the provider behind the tool you choose so it can produce your result. Our Privacy Policy explains what is shared. We do not control how a provider handles data on its own systems beyond the agreements we have with it.

7. Acceptable use

You must follow our Acceptable Use Policy, which is part of these Terms. In short, you must not use the Service for anything illegal, for sexual content involving minors in any form, for deepfakes or intimate images of real people without their consent, for impersonation, fraud, harassment or threats, to infringe others' rights, or to attack, copy or resell the Service. We may remove content and suspend or end accounts that break these rules, and report serious cases to the authorities.

8. Our intellectual property

The Service, including its software, design, text, branding and the Create name and logo, belongs to us or our licensors and is protected by law. We give you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service as these Terms allow. We keep all other rights. This does not give us rights in Your Content or your Output, and it does not cover the third-party models, which belong to their owners.

Do not copy, modify, reverse engineer or try to get the source code of the Service, and do not use the Service or its Output to build or train a competing AI model.

If you send us feedback or ideas, we may use them freely without paying you or crediting you.

We respond to valid notices of copyright infringement under the US Digital Millennium Copyright Act and similar laws. If you believe something on the Service infringes your copyright, send our designated agent a written notice that includes:

  • A description of the copyrighted work you say was infringed.
  • Where the material is on the Service, with enough detail for us to find it.
  • Your name, mailing address, phone number and email address.
  • A statement that you believe in good faith that the use is not authorized by the owner, its agent or the law.
  • A statement, under penalty of perjury, that your notice is accurate and that you are the owner or are authorized to act for the owner.
  • Your physical or electronic signature.

Our designated agent: Create, reached through the contact form (choose Legal and copyright takedown). Open the contact form to send a notice. We do not take notices by post. We cannot act on incomplete notices.

If we remove material, we will tell the account holder. If you believe material was removed by mistake, you can send a counter-notice that includes your name, address and phone number; where the material was before removal; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; a statement that you agree to the jurisdiction of the federal court for your district (or, outside the US, a suitable court) and will accept service from the person who sent the original notice; and your signature. If you send a valid counter-notice, we may restore the material unless the complainant tells us they have started a court action. We end the accounts of repeat infringers where appropriate.

10. Reports about people and likeness

If you think content made with the Service shows you, or someone you represent, without consent, including intimate or sexual images, tell us with the contact form and say where the content is. We review reports quickly. We may remove the content and act against the account that made it.

11. Beta and changing features

Some tools or settings may be in beta. Any tool or setting may be limited, changed, switched off or removed, and it may have extra terms. We may add a developer API or other products later. If we do, extra terms will apply to them.

12. Business and Enterprise plans

Business and Enterprise plans may include extra features. What is included is shown when you buy or in your order. Enterprise customers may sign a separate written agreement with us. Where that agreement says it replaces part of these Terms, it controls for that customer, and the rest of these Terms still apply.

13. Disclaimers

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE GIVE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We do not promise that the Service or any third-party model will be uninterrupted, timely, secure or error-free, that any model will remain available, or that Output will be accurate, complete, unique or free of third-party rights.

14. Limit of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, CREATE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM THE SERVICE OR ANY OUTPUT, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.

TO THE FULLEST EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) WHAT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT THAT LED TO THE CLAIM, OR (B) US$100.

Some places do not allow these limits. In that case they apply as far as the law permits. Nothing in these Terms limits liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence, and nothing removes consumer rights you have under your local law.

15. Ending your account

You can stop using the Service and delete your account yourself at any time from your Account page (/account). Deleting your account also cancels your subscriptions straight away, and the rest of the period you paid for is not refunded. We may suspend or end your account if you break these Terms, if the law requires it, if you do not pay, or to protect the Service or other people. For minor problems that can be fixed, we will usually warn you first. We may end an account immediately and without warning for serious breaches, such as sexual content involving minors or intimate images of real people made without consent.

When you delete your account, we remove your files and your sign-in. Backup copies can stay for up to 30 days. We also keep records we must keep by law. If we end your account for breaking these Terms, you are not entitled to a refund. Sections that by their nature should continue, such as payment, intellectual property, disclaimers, liability, indemnity and disputes, survive.

16. Indemnity

You agree to defend and pay for losses, damages, costs and reasonable legal fees that we or our staff suffer from third-party claims arising from Your Content, your use of the Service, your Output as you use it, your breach of these Terms, or your violation of anyone's rights, including by using a person's name, face, voice or likeness without permission. This does not apply where the law does not allow it.

17. Governing law and disputes

These Terms are governed by the laws of Australia and the courts of Australia, except that consumer protection laws that cannot be waived still apply to you.

Any dispute will go to the courts, after we first try to settle it through the contact form. To start, use the contact form and give us 30 days to try to resolve it informally.

18. General

We may update these Terms. For material changes we will give reasonable notice, for example by email or in the app, before they apply. If you keep using the Service after a change takes effect, you accept it. If you do not agree, stop using the Service and cancel your plan.

If a part of these Terms is found unenforceable, the rest stays in force. If we do not enforce a right, we have not given it up. You may not transfer your rights under these Terms. We may transfer ours, for example in a merger or sale. These Terms, with the policies named in section 1 and any order form or Enterprise agreement, are the whole agreement between you and us about the Service.

19. Contact
